I live in a Triplex.  My loan is scheduled to adjust September 1, where I will be required to pay $800 more than what I am paying now.  I currently have an interest only adjustable.  I'm going from a 6% to 8% loan then in 6 months it will adjust again to even higher.  I can make my payments as it is now at 6% but I will not be able to make it if the payments should it go to 8%.  I tried to get loan modification help on my own with some help from HUD - Operation Hope.  American Servicing denied my request and said I wouldn't be able to afford the new loan if they turned it into a fix.  I tried refinancing but they said my property just isn't worth what is was worth 1 year ago.  I don't understand why they can't freeze my rate for a couple of years until the market improves and I can get another loan. I am a sole propriortor of a swimming pool company, we do construction, retail,service and remodeling. We were doing ok until the stock market fell and the economy slowed down and then hurricane Ike hit our area. I have two vehicles that I owe 2 payments each also. My fiance who helps me with the work, was hospitalized in June of this year and our insurance canceled him so now I have over 24000.00 in hospital bills to pay. The business is a seasonal business and we are in our slow season now, although this year was a very poor season for the pool industry as a whole. There has been at least 8 pool companies that we know of that have gone out of business in the past few months and we are struggling to hold on at this time. I do have other monies owed to contractors who have agreed to work with me as long as they can. I have lost money on jobs the past two years due to circumstances beyond my control and I have a law suit pending against one that owes me over 79000.00 who has recently filed Bankruptcy but we still have suit and lein against owners & property, therefore I have attorneys fees to pay also. With all that has taken place, I have fallen behind on mortgage and vehicle payments. We do expect to recover eventually as we have work coming up but it will take time to get caught up. We have an ARM loan through Homeq Services which our loan was originally through Equifirst when we refinanced our home in 2004 to be able to open my business. My contract was suppose to be less than what it is but when I went to the closing it was more. Had I not needed the money quickly, I would have walked out of the closing. My ARM will adjust Feb. 1 2009 and my payments will go to 2400.00 per month which I will not be able to afford. I did have a company look at my paper work and they informed me that whoever did my loan had checked both conventional loan and ARM. I do not know what that means.  Our business does not usually pick back up to full strength until Feb. or March but we don\'t know what will happen at this point since it has already been slow. We are hoping that with the election over with and the stock market starting to improve somewhat that it will help our business pick up sooner. Please help modify our HomEq loan.

We puchased our home in 2005 with a 3-year ARM, and 20% in a 2nd. The intent was to refinance after 3 years and consolidate the 2 loans. The mortgage mess hit right at the time my loan adjusted, and now with the fall of housing values and increased difficulty getting a loan a traditional refinance is proving problematic. I am writing to respectfully request that you consider re-negotiating the terms of my current loan so I can continue to make payments. I have analyze my financial situation and I believe that a monthly mortgage payment of $1,500 (including taxes) would allow to me to keep current on my mortgage, pay it on time, and pay my other necessary obligations. I very much would like to be in a position where I am able to make my mortgage payments without the assistance of my co-signer or husband, neither a dependable source of supplemental income. I am however, very open to discussions in determining a mutually beneficial interest rate and monthly payment for all parties. I purchased my home in November, 2007. I was extremely excited as you can imagine. As we began the mortgage process, it was clear this was not going to be an easy process for me. My mortgage broker however was very confident he would successfully get me through the process and he did. However, the interest rate he was able to secure for me was 11.750%, I was not able to escrow my taxes as I would have liked to, and I had to obtain a co-signer. All of these factors were a concern for me but I relied on the broker’s verbal assurance that I could refinance in 6 months to lower the payments and no one stayed in this type of loan for more than a year. I quickly found out in May, 2008, by a number of different lenders that I would not be able to refinance because the city was assessing my home at a higher value then it was being appraised for and my taxes would be higher. In addition, I had not paid the winter taxes and, my debt to income ratio was higher than they would have liked. At the end of May, 2008, my husband, who was contributing to the mortgage payment and other household expenses, was laid off and his contributions stopped immediately and without warning for me to plan. This not only caused me a great deal of stress, but caused me to get severely behind on my bills, except for my mortgage. I was determined not to have any late mortgage payments on my credit report or go into foreclosure. Instead I depleted my 401K account and used the money to pay for the mortgage and other bills. My co-signer, who was helping supplement my income has become ill and has been in and out of the hospital this year. Once he become ill his contributions stopped and I actually began helping pay some of his medical expenses.  Obviously with all these different life changing events, I’ve had to make serious financial adjustments. I have cut extra curricular activities, started cooking all meals at home, and I did not renew my car lease with GMAC in May. However, I’ve exhausted all of my resources and again, am reaching out to Chase for assistance in re-negotiating the terms of my current loan. I truly hope that you will consider working with me.  I have attached the financial documents you have requested and can provide you with further financial documentation if necessary. I am looking for assistance in obtaining a loan modification with Chase mortgage.  I have a hard ship letter that can be provided for further details regarding my situation.

Issue is escrow account shortage.  Previous mortgage company did not transfer a tax payment I made to ASC when the mortgage was transferred over to ASC.  ASC assessed an escrow shortage for current year and partial past year as a result.  I phoned ASC in July and explained my financial situation involving caretaking for my 81 yr old mother in law battling cancer.  She has no income and no insurance. They instructed me that they would adjust the mortage by adding the shortage onto the end of the mortgage note.  However they did not do this and consequently have been showing my mortgage payment as a short pay for several months.  I have never received notice of the foreclosure status.  I just happened to get a post card today from a law firm that indicated the foreclosure sale date is set I have a good job.  I also have a substantial bonus to be funded in Mid March 2009.  I can utilize this bonus to fix this financial situation if ASC will work this out.  I phoned them this afternoon and they seemed agreeable to work out a repayment plan but asked for some documentation from me first.  1) a hardship letter, 2) copies of my last 2 pay check stubs, 3) a financial picture of income & expenses.  Mortgage company is Amercan Servicing Company.
